The Federal Circuit hears Nuhn Industries versus Bazooka-Farmstar, a dispute over Nuhn’s eight thirty-five patent for a vehicle that pumps liquid manure while floating. Bazooka challenged the patent at the Patent Trial and Appeal Board. The Board found all forty claims unpatentable as obvious in light of earlier technology, and rejected Nuhn’s proposed replacement claims. The claims define what the patent protects. Nuhn is appealing. A central dispute is whether the patent’s liquid manure mover requires a pump that can be immersed. Both sides treat that phrase as a means-plus-function limitation under Section one hundred twelve F: it describes what a component does, but its scope is tied to corresponding structure disclosed in the patent and equivalents. Another issue is whether Nuhn’s proposed replacement claims are supported by the original description of the invention.
