In re Jefferson Street Holdings LLC — Fed. Cir. (Nov 2, 2026)
The Federal Circuit considers Jefferson Street Holdings' appeal from reexamination, the Patent Office's review of an already granted protective smartphone-case patent. The case is designed to shield the phone while leaving its screen accessible, using higher edges at the ends and lower edges along the sides. The patent's claims, its written boundaries of protection, describe a lower side-edge height that is continuous between two transitions. The key question is whether that height must stay constant, or may vary as long as the side remains above zero. That interpretation affects comparison with earlier case designs relied on as prior art. The judges also examine obviousness: whether the claimed arrangement would have been obvious to a skilled designer at the time. A claim can fail that test even without an identical earlier disclosure. So interpreting continuous more narrowly would not, by itself, decide whether making the side height constant was obvious.
