Cocona, Inc. v. VF Outdoor, LLC — Fed. Cir. (argued September 14, 2026)

The United States Court of Appeals for the Federal Circuit hears Cocona, Inc. v. VF Outdoor, LLC. Cocona owns a patent for a waterproof, breathable membrane used in outdoor apparel. It sued VF Outdoor and Columbia Sportswear in 2016, alleging that their products infringed that patent. After earlier Patent Office proceedings knocked out other patent claims, Cocona focused on claims that require a moisture vapor transmission rate within a stated range. The district court held those remaining claims invalid because the patent described more than one way to measure that rate, but did not tell a skilled reader which method or conditions controlled. Cocona now asks the Federal Circuit to reverse, arguing that VF and Columbia did not prove indefiniteness by clear and convincing evidence.
