Evans v. Collins — Fed. Cir. (argued September 11, 2026)

Marine Corps veteran Wilbert Evans, a mail clerk in Japan, said he flew to Vietnam escorting mail. Veterans Affairs rejected his account for lack of records. The Veterans Court reversed, found his Vietnam service established, and ordered diabetes benefits. Veterans Affairs separately granted multiple-myeloma benefits for Camp Lejeune contamination from March 2017. His widow, Mary Evans, asked the court to apply the Vietnam finding and move that date back to his December 2013 claim. It refused because her briefs had not requested myeloma relief. The Federal Circuit decides whether it may review that waiver ruling.
