FlightSafety Defense Corporation v. US — Fed. Cir. (argued September 10, 2026)
The Federal Circuit reviews summary judgment for the United States in FlightSafety Defense's contract dispute with the Air Force. FlightSafety built KC-46 simulators while Boeing was still developing the aircraft, and delayed design data increased its costs. FlightSafety says the Air Force promised an initial compliant data package and withheld key delay information. The government says the fixed-price contract made FlightSafety responsible for obtaining the data and bearing that risk. The question is whether any of FlightSafety's contract claims can proceed.
