S.D., et al. v. Reese, et al. — 9th Cir. (argued August 27, 2026)

The Ninth Circuit reviews a preliminary injunction and provisional class certification over Oregon's housing reviews for transgender women in custody. A preliminary injunction provides temporary relief before final judgment. The district court ordered new individualized reviews, starting from a presumption favoring housing consistent with gender identity while considering each person's preferences, safety, medical needs, and other factors. Oregon says aggregate data do not prove a statewide default. S.D., J.F., and the class say the data and declarations support temporary class-wide relief.
