The Ninth Circuit considers whether Edmond Paul Price's federal habeas petition, a challenge to his state conviction, should have been dismissed as late without an evidentiary hearing. Federal law generally gave Price one year to file. He seeks equitable tolling, an extension available when an extraordinary obstacle prevents timely filing despite reasonable diligence. Price says prison officials interfered with legal mail and electronic filing, while months of mail logs are missing. The State says his descriptions of filing attempts are too vague and too late. The court must decide whether disputed facts require a hearing.
