Dawson v. Target Corporation — 9th Cir. (argued July 9, 2026)

The Ninth Circuit considers whether Dylan Dawson agreed to arbitrate claims against Target and its delivery subsidiary, Shipt, by using Target's mobile app. Target says Dawson necessarily encountered sign-in and checkout screens that linked to terms containing an arbitration clause. Dawson says Target did not prove which screens he saw and that the notices were too inconspicuous to create a contract. The district court denied arbitration because Target had not shown adequate notice or unambiguous assent.
