United States v. Arturo Contreras Soto — 9th Cir. (Sep 17, 2026)

The Ninth Circuit hears United States versus Arturo Contreras Soto. Tucson officers warned Soto after seeing him ride an electric bicycle with an open alcohol container. When they saw him do it again the next day, they arrested him and searched a satchel he was wearing before taking him to jail, finding a handgun. The district court ruled that the search was not valid as incident to arrest but was a lawful inventory search under Tucson police procedures. After suppression was denied, Soto was convicted of possessing a firearm as a felon. He says the field search was investigatory, not an inventory. The government says policy required it before transport regardless of investigative suspicion.
