State of Nevada v. Optum, Inc., et al. — 9th Cir. (Sep 28, 2026)

Nevada's opioid lawsuit accuses pharmacy benefit managers, including OptumRx and Express Scripts, of helping worsen the state's opioid crisis. Nevada says their decisions about covered drugs and prescription controls contributed to excessive opioid use. The companies moved the case from Nevada state court to federal court because they also administer drug benefits for federal health plans. Nevada excluded claims arising from that federal work, and the federal judge sent the suit back to state court. The companies now ask the Ninth Circuit to reverse that remand; Nevada wants the case to stay in state court. This appeal is about which court may hear the lawsuit, not whether the companies caused the alleged harm.
