Uwaoma v. OTS Solutions, LLC, et al. — 9th Cir. (Oct 29, 2026)

No. 25-2174 Argued October 29, 2026 Published October 30, 2026

The Ninth Circuit considers whether a warehouse worker's wage-and-hour lawsuit must go to individual arbitration. Danielle Uwaoma describes receiving and scanning goods, stocking them, and preparing shipments for delivery. She brought a proposed class action against OTS Solutions and NFI. The district court denied the companies' motion to compel arbitration, applying a transportation-worker exemption. Section One of the Federal Arbitration Act excludes certain transportation workers' employment contracts from that federal law. Does handling shipments inside a warehouse put her within that exemption? An interlocutory appeal is an appeal before the whole lawsuit has ended. This argument concerns where and how the claims will be heard, not whether wage violations occurred.
