Hangxiao Che v. Daimler Truck North America LLC — 7th Cir. (Oct 26, 2026)
The Seventh Circuit hears the Che and Yao appeals against Daimler. These suits follow a September twenty-nineteen tour-bus crash in Utah that killed and injured passengers. The claims concern the bus's chassis design and the retailer's role in selling it. The district court granted summary judgment for the defendants, resolving the claims without a trial. But the argument begins with a more basic question: was the federal court authorized to hear these cases at all? Subject-matter jurisdiction means authority over this kind of case; personal jurisdiction means authority over a particular defendant. Diversity jurisdiction depends on the parties' citizenship. A limited liability company, or LLC, takes its members' citizenships, not simply the location of its business. For the suit removed from California state court, the lawyers debate remand, meaning sending it back there, versus dismissal. A jurisdictional dismissal does not decide whether the bus was defective. David Wright represents the plaintiffs.
