Charles Greenwood v. Express Technologies Ltd. — 7th Cir. (Oct 27, 2026)
The Seventh Circuit hears a consumer dispute over which version of an online company's terms controls. Charles Greenwood sued ExpressVPN, alleging unwanted automatic subscription renewals and difficulty canceling. The company sought to send the lawsuit to private arbitration rather than court. Its earlier terms required arbitration, but the company later removed that requirement. The district judge found that the updated terms replaced the earlier agreement and declined to compel arbitration. The company's lawyer will ask the appeals court to enforce the original arbitration clause. Greenwood's lawyer will defend the conclusion that the company is bound by its own revised terms. There is another wrinkle: those newer terms direct litigation to courts in the British Virgin Islands. Defeating the old arbitration clause would not, by itself, establish that the lawsuit belongs in Illinois.
