Dignity Health v. Health Care Service Corporation — 7th Cir. (Sep 28, 2026)

Dignity Health asks the Seventh Circuit to revive its hospital-payment lawsuit against Health Care Service Corporation. The district court dismissed the complaint, including rejecting the contract claim for lack of consideration—the new value or promise exchanged to create a contract. Doing what an existing legal duty already requires ordinarily cannot supply that new bargain. The lawyers also discuss quantum meruit: payment for the reasonable value of services when no enforceable contract governs them.
