A sales brochure leads two insurance businesses into a federal trademark appeal. Bankers Life and CDOC say a brochure made for American Senior Benefits used the Bankers Life name or logo. The companies sued for trademark infringement and unfair competition under the Lanham Act. After years in district court, Bankers Life and CDOC now ask the Seventh Circuit to revisit the dispute. At argument, the panel asks whether a mark shown at an internal meeting of insurance agents counts as commercial use under the statute, even without proof that a customer saw the material. The lawyers also dispute whether possible confusion among agents can matter when actual customer confusion has not been shown.
