USA v. Donovan Alexander — 7th Cir. (Nov 6, 2026)
The Seventh Circuit hears a sentencing appeal in a case about the commercial sexual exploitation of a minor. Prosecutors accused Donovan Alexander of trafficking a minor girl and transporting her for that purpose. This appeal focuses on a separate sentencing adjustment for undue influence. The judge applied a two-level increase. Under the guideline commentary, an age difference of at least ten years creates a presumption of undue influence, but that presumption can be challenged and the court must consider the facts of the case. Alexander's lawyer will argue that the judge did not adequately consider the evidence offered to challenge that presumption. The government will defend the judge's assessment and argue that the adjustment did not change the advisory sentencing range. Listen for how the panel separates the guideline's starting presumption from the individual finding the judge must make.
