The Fifth Circuit hears Dyer v. New Orleans City. New Orleans fire captain Varrick Dyer alleges race discrimination and retaliation. The district court dismissed his retaliation and hostile-work-environment claims, then entered summary judgment for the City on claims involving discipline and a special-operations assignment. The appeal asks whether disputed facts should have gone to a jury.
