Jackson Federation of Teachers v. Fitch — 5th Cir. (Aug 31, 2026)

The Fifth Circuit reviews a preliminary injunction against parts of Mississippi House Bill 1193, a law governing how public schools address race and sex. The challengers say the provisions are vague and chill speech; Mississippi calls the tests wrong and the relief overbroad. The panel also considers reassignment after a law clerk used AI while drafting a temporary restraining order filed before review. Mississippi Deputy Solicitor General Anthony Shults will ask the court to vacate the injunction.
