Louisiana Bucket Brigade v. Louisiana Department of Environmental Quality — 5th Cir. (argued August 31, 2026)
The Fifth Circuit reviews three emissions limits in Louisiana's permit for Venture Global's CP2 LNG terminal. Louisiana Bucket Brigade and Sierra Club will contend that LDEQ never explained why CP2's combined-cycle turbines could not meet lower limits used at grid-connected plants. Louisiana and Venture Global will answer that the limits reflect CP2's isolated power-island operation and fuel mix. David Bookbinder will represent the groups and will first address whether they have standing to challenge those three limits.
