GH America v. Fohn — 5th Cir. (argued September 1, 2026)
The Fifth Circuit considers whether federal foreign-investment law preempts a Texas restriction on access to its electric grid. GH America Energy is subject to a federal national-security mitigation agreement. Eliyahu Ness of Ness PLLC will represent GH America. He will argue that Texas cannot categorically bar the company from activity covered by federal supervision. The district court dismissed the suit.
