State of Texas v. Johnson & Johnson — 5th Cir. (argued September 1, 2026)
The Fifth Circuit considers who should pay the legal fees caused by moving a Texas Tylenol lawsuit into federal court. Texas alleges that Johnson & Johnson and Kenvue violated state consumer law in marketing Tylenol. The judge sent the suit back to state court but denied Texas its fees. Ashley Keller of Keller Postman will represent Texas. He will argue that removal lacked an objectively reasonable basis and that the judge used the wrong legal standard.
