W.H. v. Fort Bend ISD — 5th Cir. (argued September 2, 2026)

The Fifth Circuit considers whether W.H., a high-school student with disabilities, should receive English and math instruction in general classes or in self-contained special-education resource classes under the Individuals with Disabilities Education Act. A hearing officer approved resource placement for math but not English; the district court approved it for both. Mark S. Whitburn of Whitburn & Pevsner represents W.H. He will ask the court to reverse, arguing that W.H.'s grades and progress, and the law's preference for education alongside nondisabled peers, support keeping him in general classes.
