Fischer v. Phillips — 5th Cir. (Sep 1, 2026)

The Fifth Circuit hears Fischer versus Phillips. Cyndi Fischer sued Officer Robert Phillips over his fatal shooting of Jesse Fischer following a low-speed pursuit. The district court dismissed the suit at the pleading stage. The appeal asks whether the complaint and videos plausibly show excessive force and whether qualified immunity bars the suit.
