Fischer v. Phillips — 5th Cir. (argued September 1, 2026)

The Fifth Circuit hears Fischer versus Phillips. Cyndi Fischer sued Officer Robert Phillips after he fatally shot her son, Jesse Fischer, during a low-speed pursuit. The district court dismissed her claims at the pleading stage. The appeal asks whether the complaint and videos plausibly show excessive force and whether qualified immunity bars the suit.
