Ocampo Fitz v. Venegas Nunez — 5th Cir. (argued September 1, 2026)

The Fifth Circuit hears a dispute over U.S. rights to the band name Los Yaguaru de Angel Venegas. Zeferino Ocampo Fitz says common-law rights passed to him through assignments beginning in 2009, or arose from his U.S. management and promotion of the band. The district court held on summary judgment that the agreement transferred only specified Mexican rights and that Fitz could not establish U.S. ownership. It dismissed his false-association and unfair-competition claims, then his request to cancel Elizabeth Venegas Nunez's federal registration. Common-law trademark rights arise from use without federal registration; rights in one country do not automatically carry into another. A trademark transferred without its business goodwill is an assignment in gross and is generally invalid. Fitz asks the Fifth Circuit to reverse.
