The Fifth Circuit hears David Koan's direct criminal appeal. Section 5G1.3(b) of the Sentencing Guidelines can require an adjustment for time already served on a related undischarged sentence when the Bureau of Prisons will not credit that time. For an unpreserved claim, an appellant must show a clear or obvious error affecting substantial rights. The court then decides whether correction is warranted under the fairness, integrity, or public-reputation standard.
