United States v. Koan — 5th Cir. (argued September 1, 2026)

The Fifth Circuit reviews David Koan's federal sentence. The dispute is whether the district court correctly applied Guideline Section 5G1.3(b), which can require an adjustment for related time that the Bureau of Prisons cannot credit again, and whether the judge improperly let a probation officer resolve the objection. The court must also decide whether Koan preserved those issues. An unpreserved claim faces plain-error review, which requires a clear error that affected the outcome and seriously threatens judicial fairness.
