The Second Circuit hears SlackPass versus Frosted, a dispute between LaunchPass and its competitor Whop. The district court refused to send several claims to arbitration, finding that the defendants had given up that right by first seeking dismissal in court. The appeal asks whether that litigation conduct waived arbitration and how LaunchPass's jury-waiver clause should be read.
