O'Neill v. NYU Langone Hospitals — 2d Cir. (Nov 5, 2026)

No. 25-2978 Argued November 5, 2026 Published November 6, 2026

The Second Circuit hears O'Neill's appeal in a lawsuit against three New York hospitals. O'Neill says the hospitals mishandled her care and medical records after she reported sexual assaults. She alleges that records were falsified and information was disclosed without her consent to conceal wrongdoing. These are her allegations, not established findings. The district court dismissed her claims and refused another amended complaint, concluding that the proposed allegations still did not state legally sufficient claims. Representing herself, she will argue that she lacked important information and should be allowed to revise her complaint again. The hospitals will defend the requirements for pleading a claim. This is an argument about whether her lawsuit can proceed, not a trial to determine whether the alleged assaults occurred.
