Salazar v. National Basketball Association — 2d Cir. (argued June 16, 2026)
The Second Circuit hears Michael Salazar’s second appeal over the NBA website’s Facebook Pixel, tracking code he says linked him to videos he watched. The Video Privacy Protection Act generally restricts disclosure of a consumer’s personally identifiable viewing information. The district court dismissed his claim under circuit precedent requiring the data to identify a viewer to an ordinary person. An earlier appeal held that his free NBA newsletter subscription made him a consumer. Joshua Hammack of Bailey & Glasser will argue for Salazar that later Supreme Court decisions undermine that test. Hilary Preston of Vinson & Elkins will argue for the NBA that the panel remains bound by it and should affirm.
