United States of America v. Saunders — 2d Cir. (Nov 6, 2026)
The Second Circuit hears a renewed sentencing appeal arising from a conviction for possessing a firearm despite earlier felony convictions. The defendant's record included three prior violent felonies, and the original judge applied the Armed Career Criminal Act's fifteen-year minimum. A new district-court judgment in 2025 brought the case back to the appeals court. Against that history, listen for two different questions: did the judge consider the defendant's personal circumstances, and did the judge give those circumstances enough weight? A sentencing judge must also consider the seriousness of the offense, deterrence, and public safety. Does changing the sentencing framework require a proportionately larger reduction, or can the judge weigh the same circumstances differently? Listen for the explanation and balance behind the sentence, rather than simply a mathematical discount.
