The Second Circuit considers a funding dispute between the city Department of Education and the parents of 18 students with disabilities at iBRAIN, a private school. For 2025–26, the parents filed administrative complaints alleging that the city had not offered appropriate programs and seeking funding for tuition, transportation, and nursing where applicable. They then sued in federal court, seeking a preliminary injunction declaring iBRAIN the students' stay-put placement and requiring funding while the administrative cases continued. Stay-put generally keeps a student in the last agreed program at public expense while a special-education dispute is pending. The district court denied preliminary relief after finding no irreparable harm. By oral argument, the 2025–26 school year had ended. The court must decide whether the completed school year makes this appeal moot and, if not, whether stay-put permits ordinary-course funding without proof that delayed payment threatened a placement.
