Beniquez v. New York State Unified Court System — 2d Cir. (Sep 24, 2026)

A New York court officer's sexual-harassment lawsuit turns on what a federal judgment did not say. Elizabeth Beniquez sued the state court system and a fellow officer she accused of repeated unwanted advances. The trial judge dismissed her federal claim against the court system and wrote that both sides agreed state sovereign immunity barred her state-law claim in federal court. But the order did not expressly say whether that state-law claim was dismissed without prejudice. Beniquez wants that clarification so she can try the claim in state court, where other defenses could still apply. Michael Taubenfeld of Fisher Taubenfeld will ask the panel to clarify the judgment.
