Hernandez v. Jafri — 2d Cir. (Sep 21, 2026)
We hear the Second Circuit argument in Hernandez's appeal from the dismissal of his federal civil-rights lawsuit. The dispute grew out of his state-court personal-injury case, where he alleges misconduct surrounding a deposition. He sued lawyers involved in that case, including his own lawyer. Hernandez wants the case sent back so he can obtain a video of the deposition. The district court dismissed his federal claims and declined to decide his remaining state-law claims. The issue here is whether his allegations support a federal civil-rights claim, rather than a possible claim under state law. Section nineteen eighty-three generally requires a rights violation attributable to state government, not purely private conduct.
