United States v. Allen Pendergrass — 11th Cir. (argued August 11, 2026)
The Eleventh Circuit considers whether Allen Pendergrass can satisfy a mandatory two-year sentence for aggravated identity theft through home confinement rather than two years in prison. Pendergrass was convicted in a scheme that used forged documents to steal unclaimed funds. His first appeal upheld the convictions but returned the case for resentencing because the judge had not allowed allocution, the defendant's chance to speak before sentence is imposed. At resentencing, the judge concluded that Section 1028A required imprisonment. Pendergrass says home confinement on supervised release can meet that requirement. The government says it cannot.
