Kevin Harrell v. City of West Palm Beach — 11th Cir. (Nov 5, 2026)

No. 24-12814 Argued November 5, 2026 Published November 6, 2026

The Eleventh Circuit hears Harrell versus the City of West Palm Beach. Harrell was a police officer who became the subject of a criminal investigation into suspected disclosures of police information. Investigators obtained a warrant to search his cell phone, and potential workplace violations were later referred to internal affairs. The city says he disclosed confidential information and was untruthful during the internal inquiry. It dismissed him after a disciplinary hearing. Harrell disputes the city's explanation for his dismissal. This is a civil employment appeal, not a criminal trial. You will hear about federal criminal Rule forty-one G, which provides a procedure for seeking the return of seized property. Keep two questions separate: what justified the employment decision, and what legal procedure can be used to challenge the use of search material in a civil case.
