American Food & Vending Corporation v. The Goodyear Tire & Rubber Company — 10th Cir. (Sep 15, 2026)
American Food and Vending provided vending services at Goodyear tire plants in Fayetteville, North Carolina, and Topeka, Kansas. Goodyear ended the Fayetteville agreement in 2021 and the Topeka agreement in 2024, each on forty-five days' notice. American Food says the contracts required notice and time to fix a problem before any termination; Goodyear says either side could instead end the deal without cause on forty-five days' notice. A Kansas district judge sided with Goodyear on summary judgment, and American Food appeals that reading of the contracts.
