The First Circuit hears United States ex rel. Cohen versus Lahey Clinic Hospital. Richard Cohen, a former Lahey patient suing for the United States under the False Claims Act, alleges that Lahey overbilled Medicare for Botox by billing twice for discarded units and using needlessly large vials. The district court dismissed his complaint. The appeal asks whether those allegations plausibly show scienter—actual knowledge, deliberate ignorance, or reckless disregard—rather than billing mistakes.
