The First Circuit considers whether Northeast Marine Pilots can be responsible for a pilot's alleged negligence. Codan brought the claim as Hays Ships' subrogee, meaning it asserts Hays Ships' rights. The district court dismissed the claim against Northeast. The question is whether Codan plausibly alleged that Northeast could control the pilot's work.
