Gracia Gracia v. FOMB — 1st Cir. (Nov 3, 2026)
We hear the First Circuit. The litigation began with drivers who already had private auto insurance but also paid Puerto Rico's compulsory-insurance premium. They sought refunds of those duplicate payments and challenged the notice they received about recovering their money. A settlement eventually established a refund-claim process. It also provided for the lawyers to receive twenty percent of the reimbursement claims paid under the agreement. That fee provision is the focus of this argument. As you listen, distinguish approval of a refund claim from actual payment: the agreement ties the fee to claims that are paid. You will also hear an initial discussion of appellate jurisdiction, meaning the appeals court's authority to decide the appeal. Those are separate questions: what the agreement requires, and whether this is the stage at which the appellate judges can decide the dispute.
