United States v. Hemani — SCOTUS (argued March 2, 2026)

The Supreme Court considers whether federal law may bar Ali Hemani from possessing a gun solely because he used marijuana a few times a week. The Fifth Circuit dismissed his indictment under the Second Amendment. The Court later unanimously affirmed. It held that historical laws aimed at severely impaired habitual drunkards did not justify automatically disarming Hemani without regard to how much marijuana he used, what effect it had on him, or whether his use made him dangerous.
