United States v. Rahimi — SCOTUS (argued November 7, 2023)

No. 22-915 Argued November 7, 2023 Published July 4, 2026; updated August 16, 2026

The Supreme Court considers whether Congress may bar a person under a domestic-violence restraining order from possessing firearms. A Texas court found that Zackey Rahimi posed a credible threat and issued such an order. After police found guns in his home, he was charged under Section 922(g)(8). The Fifth Circuit held the law unconstitutional under Bruen's history-and-tradition test. The Supreme Court later reversed, eight to one, holding that a court may temporarily disarm a person it finds poses a credible threat.
